Application of the Cartagena Declaration of 1984 to Haiti

As of July 2024, COMAR applies the expanded definition contained in the 1984 Cartagena Declaration to applications from Haitian nationals, considering that a situation of generalized violence prevails in Haiti. This decision is the result of the work of COMAR’s Protection team, with the support of UNHCR, to adjust its analysis criteria to apply this declaration to the realities of Haiti. As part of this process, the information on the country of origin, the interview guide and the resolution templates were updated.

Increase in the recognition rate: Thanks to the implementation of this measure, from July to December 2024, the recognition rate of refugee status for Haitian nationals in Mexico increased 2.5 times. More Haitian nationals can be recognized as refugees, guaranteeing their international protection.

More efficient processing: With training and tools developed to support eligibility clerks, they are able to assess cases more clearly and quickly.

Increased access to rights: By obtaining refugee status, Haitians gain access to fundamental rights such as legal residency, employment, family reunification, etc.

Strengthening the protection framework: This measure aligns COMAR’s practice with current international standards and reinforces Mexico’s commitment to refugee protection.
